These terms and conditions govern your access to and use of the NqshaBazzar website (the “Site”), including any content, information, products and/or services (the “Services”) therein. This is a legal agreement between you and NqshaBazzar (“Company”). Company reserves the sole right at any time to modify, discontinue or terminate the Site and Services, or modify the Terms of Service without notice. All modified terms and/or conditions will be in effect after they are posted on the Site (unless applicable law requires a longer notice period). By continuing to use or access the Site and/or Services after Company makes any such modification, you agree to be legally bound by the revised Terms of Service. You may not alter the terms and conditions of the Terms of Service without Company’s express written consent.

YOU UNDERSTAND THAT BY USING THE SERVICES OFFERED BY COMPANY THROUGH THE SITE, YOU AGREE TO BE BOUND BY THE TERMS OF SERVICE. IF YOU DO NOT ACCEPT THE TERMS OF SERVICE IN THEIR ENTIRETY, YOU MAY NOT ACCESS OR USE THE SERVICES OFFERED BY COMPANY.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property and all house plans, architectural designs, elevation views, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the Pakistan, international copyright laws, and international conventions. Reproduction of these home plans or any content that is the property of the website either in whole or in part, including any form of copying and/or preparation of derivative works thereof, for any reason without prior written permission, is strictly prohibited and subject to statutory damages plus attorney fees and loss of profits.  The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission. Provided that you are eligible to use the site, you are granted a limited license to access and use the site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

CUSTOM DESIGNS

NqshaBazzar will be responsible in creating create new custom plans as per the customized query been submitted or discussed to the NqshaBazzar team on the website or over call/Moreover, regular updates on housing plans, designs and elevations will be provided to give you an exact picture of how the plans will function and how the building will look like. Changes can be requested up to 3 times during the sketch stage of designing the plans. Any further changes after this or after final approval of sketch design by client will be charged an additional hourly fees of PKR 2000 per hour.

Please note that the copyright terms (under the heading COPYRIGHT NOTICE) also apply to custom designed plans. Please contact us if you would like to have exclusive rights of the design and plans at an additional cost.

PRICING

Prices are subject to change without notice. Due to the extensive plan inventory and diverse price options available on www.naqshabazzar.com, we may occasionally find data entry errors in the pricing of our plans. NaqshaBazzar reserves the right to correct such errors as they are discovered. No order and pricing shall be final until confirmed by NaqshaBazzar.

PHOTOGRAPHS, PERSPECTIVES AND ELEVATION VIEWS:

All Home Plans have at least 1 photograph, perspective or elevation view to help you visualize the Homes – these are only to be used as general guides to what the Home may look like when built.

Please be advised that photographs, perspectives and elevation views may not represent the final construction sets accurately due to changes made during construction or the rendering process. Also note that all details shown on pictures, perspectives and elevations are not necessarily part of the final drawings package that you purchase as some are only used for decorative and illustrative purposes.

DO NOT USE PLANS TO BUILD MORE THAN ONE HOUSE

The original purchaser of a home plan is licensed to build a single home from the plans. Building more than one home from the plans without permission is an infringement of the home designer’s copyright. The drawings you receive in your email or as printed copies can only be used to build one home, if you need to build more than one home using the same plans you will need to purchase one set for each of the extra homes.

USER REGISTRATION

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

USER REPRESENTATIONS

By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Site through automated or non-human means, whether through a bot, script, or otherwise; (6) you will not use the Site for any illegal or unauthorized purpose, and (7) your use of the Site will not violate any applicable law or regulation If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).
